Air's, Rails, cable parks, Winch, big surf, small surf, Waterfalls, Stationary waves, Swimming, Posing with H2O Audio product like a Calvin Klein ad, jumping off diving boards, etc, etc......Be Creative! I think you get the picture. So get out your Polaroid Camera's, dust off those old Bulb cameras, lets get to picture taken .... !!! Good Luck...... and may the force be with you!!
Official Photo Contest Rules
Start date: November 3, 2008 End date: January 1, 2009
Grand Prize: $200/ Photo used in an H2O Audio Ad placed (Print or online)
Contest winners will be announced on January 15, 2008.
Estimated value of the prize is $1000.00 Substitution for any prize may be necessary due to unavailability, in which case a comparable prize of equal or greater value will be awarded. H2O Audio reserves the right to change these Official Rules, at any time, with or without prior notice.
Eligibility
The H2O Audio Photo Contest (the “Contest”) is open to residents of the Continental United States. Employees of H2O Audio and affiliated companies and members of those employees’ immediate families are not eligible. The chances for winning depend on the total number of entries received. No purchase is necessary to win.
To Enter
To enter you must upload a photo to the contest site (the “Uploaded Content”) by completing the following:
• Visit h2orider.com
• You must then click the “Submit Photo” link to initiate the process.
• If you are already a registered member of the Loop’d network you may use your login information to login to the contest upload page. If you are not a member of the H2O Audio Network you will be required to register prior to the submission of a photo.
• All photos will be reviewed prior to release to the contest by a site representative.
• Photos should be relevant to the contest and must be submitted in one of the following formats: .jpg, .gif, or .png. and at 300 dpi. All photo content/quality must be clear and decipherable. Any photos containing nudity, foul language, graphic or offensive materials will be rejected.
• Any photo that you submit to the Contest must be specific to watersports and showcase H2O Audio product. Any photo that is uploaded to the Contest that does not pertain to the Watersports subject matter may be removed and will not be eligible to win a prize.
In the event of a dispute over your identity, the Uploaded Content will be deemed submitted by the holder of the e-mail account. H2O Audio Network is not responsible for technical failures in entry transmission, or lost, late, misdirected, damaged, or incomplete entries. H2O Audio is not responsible for any damage to your computer occasioned by participation in the Contest or downloading any information necessary to participate in the Contest. H2O Audio reserves the right, at its sole discretion, to cancel the Contest if it becomes technically corrupted, and select winners from all eligible entries received before cancellation.
H2O Audio reserves the right to remove any Uploaded Content which, in its sole discretion, is deemed to be inappropriate, offensive, or in violation of these Contest rules. H2O Audio also reserves the right, in its sole discretion to disqualify you in the event you are deemed to have tampered with the entry process or voting process, violated these Contest rules, or have acted in an unsportsmanlike way or disruptive manner with the intent to threaten, harass, abuse, or annoy another person in connection with the Contest.
Entry Conditions
As a condition of entry into this contest and by uploading content to the contest site, you represent and warrant the following regarding your Uploaded Content: (i) the Uploaded Content is original and legally created; (ii) the Uploaded Content does not infringe on intellectual property, privacy or publicity rights or any other legal or moral rights of a third party; (iii) you own all rights to the Uploaded Content, including but not limited to, all copyrights related to the Uploaded Content; (iv) the Uploaded Content has not been entered in or won a previous contest or award; and (v) the Uploaded Content has not been previously published or distributed by the media. You further represent and warrant that you have obtained the express permission from each person whose name, image, likeness, and/or voice may appear in the Uploaded Content to use such person’s name, image likeness, and/or voice, and that, upon H2O Audio request; you are permitted to make copies of the Uploaded Content. If the Uploaded Content contains the name, image, likeness, and/or voice of a minor, such consent must include the written contest of said minor’s parent or legal guardian.
By uploading the Uploaded Content, you irrevocably grant H2O Audio and its affiliates, legal representatives, assigns, agents and licensees, the unconditional and perpetual right and permission to reproduce, broadcast, post, publish, transmit, display, publicly perform, encode, store, copy, adapt, exhibit and/or otherwise use or reuse (without limitation as to when or to the number of times used), the Uploaded Content, as submitted or as edited/modified in any way by H2O Audio in its sole discretion, as well as to use your name, likeness, photograph, and/or statements regarding your participation in the Contest in any and all media without limitation as to time or territory, and without additional compensation or approval from you or any other party. You hereby waive intellectual property rights, privacy/publicity rights or other legal or moral rights that might preclude H2O Audio use of the Uploaded Content, and agree not to assert any claim against H2O Audio for the use of the Uploaded Content or your name, likeness and/or voice. You agree to indemnify and hold H2O Audio, its agencies and their respective affiliates, officers, directors, agents, co-branders or other partners, including, but not limited to, Diver Entertainment, Inc., and any of their employees (the " H2O Audio Indemnitees"), harmless from any and all claims, damages, expenses, costs (including reasonable attorneys' fees) and liabilities (including settlements), brought or asserted by any third party against any of H2O Audio Indemnitees due to or arising out of the Uploaded Content, or your conduct in creating the Uploaded Content or otherwise in connection with the Contest, including but not limited to claims for trademark infringement, copyright infringement, violation of an individual’s right of publicity or right of privacy; or defamation. You further agree to release H2O Audio Indemnitees from any and all claims that any advertising subsequently produced, presented, and/or prepared by or on behalf of H2O Audio infringes your rights with regard to any elements, characters or ideas contained in any Uploaded Content.
Selection of Contest Winner
One winner will be selected at the end of the two month contest. Contest ends January 1st, 2009. Each photo will be submitted to a panel of H2O Audio judges who will determine the best overall photo. The contest prize is a Check for $200 and use of photo in an H2O Audio ad. Estimated value for the contest prize is approximately $1000.00. The contest winner shall be notified on January 15, 2009 following the conclusion of the two month contest. The contest winner will be notified by mail, e-mail or telephone within 3 days of the determination. Any prize or prize notification returned to H2O Audio as undeliverable will result in the awarding of that prize to an alternate winner. Except as required by law, H2O Audio will not share entrant information with any third parties. H2O Audio may contact you in the future with offers we feel may be of interest and by entering the Contest, you expressly consent to receiving such communications. The Contest is governed by laws of United States. Any claims relating to this Contest must be resolved in the United States. For a list of Contest winners, send a self-addressed envelope to “H2O Audio Photo Contest” at the address below between November 1, 2008 and November 30, 2009. All taxes are the responsibility of the winner and the winner agrees to supply Loop’d Network with his/her social security number prior to being awarded a prize. Prizes are non-transferable or assignable. H2O Audio reserves the right, in its sole discretion, to conduct background checks on the winners to ensure that the use of any such person in advertising campaigns or publicity will not bring H2O Audio or any of the Contest participants into scandal, ridicule, contempt, public disrepute, or reflect unfavorably on the Contest and H2O Audio.
